Senators are currently editing S. 510 behind closed doors, as they draft the Manager's Amendment Package, which may be substituted in place of the current Food Safety bill. If any draconian language is any bill, it should be adamantly opposed.
No draconian longterm jail terms for adulterating or misbranding food is acceptable. According to FDA's interpretation of "adulterating" and "misbranding" you could go to jail for citing scientific research from universities about your food product. That is outrageous.
I agree that jail-time is appropriate if anyone who consciously AND recklessly disregards risk of death or serious bodily injury however, risk-of-death and serious bodily injury must be proved scientifically with sound methods not simply believed allegations. Targeting food and supplements by making a lapse in filing to the FDA subject to any longterm jail time is unjustifiable and preposterous (see the reference to subsection V of Section 301 of the Federal Food and Drug Act).
Although the Food Safety bill may have good intentions, it is a misguided attempt to protect our food supply or ensure the safety of supplements. There is still too much risk that natural product growers or makers will be threatened, silenced, and penalized.
Please adamantly oppose inclusion any draconian term in any Food Safety bill!
